Use this Form to assess, at any time, whether a contract is a Strategic Digital Contract as defined in the Digital Seller Underperformance Policy (DSUP) Glossary.
This form will also help you decide whether to report Serious Underperformance to the Digital Transformation Agency (DTA) using the Serious Underperformance Report (DSUP002) form.
Refer to the Digital Seller Underperformance Policy: Standard (DSUP Standard) and the Digital Seller Underperformance Policy: Guidance (DSUP Guidance) to understand the reporting process and key terms.
Who this form applies to
- Buyers and Sellers who are unsure if a contract is a Strategic Digital Contract under the DSUP.
- Buyers considering submitting a Serious Underperformance Report to the DTA using the Serious Underperformance Report (DSUP002) form.
What you need to know
- Engage with the Seller prior to completing this form. DSUP is not an escalation or dispute resolution process for contract issues. It does not override or replace standard contract management procedures or legal remedies. Buyers remain responsible for managing their contracts, including addressing underperformance through the contract’s dispute or performance management clauses, and for exercising any contractual rights or remedies as appropriate.
- Check the disclosure rights and obligations in your Strategic Digital Contract prior to disclosing information to the DTA – for example, to avoid inadvertent disclosure of confidential information and/or personal information under your Strategic Digital Contract.
- You should not submit this form and the Serious Underperformance Report (DSUP002) form to the DTA if the alleged underperformance is actively under investigation or subject to court proceedings, until proceedings are concluded. For example, during a fraud investigation or litigation. If an investigation or proceedings eventually provide an adverse finding, a Buyer may then report Serious Underperformance to the DTA under the DSUP, if the Buyer considers it impacts the Seller's suitability for future work.
You may use this Form at any time to assess whether your contract is a Strategic Digital Contract (including on multiple occasions over the term of your contract). For example, if your answers to questions 1 to 6 in the Self-Assessment Tool below are ‘no’ and circumstances under your contract change at a later point, you may wish to undertake the Self-Assessment Tool again.

- Note the online form for the Serious Underperformance Report (DSUP002) is able to support information you have assigned a Security Classification up to and including OFFICIAL: Sensitive.
- If you have assigned a Security Classification of PROTECTED or above to the information to be included in your forms, follow the steps outlined in the Digital Seller Underperformance Policy: Guidance.
Submit your form
- You can complete and submit this form if you are an authorised representative of a Buyer engaged in a contract with a digital Seller. The terms Buyers and Sellers for DSUP purposes are defined in Appendix A: Glossary of the DSUP.
- If completion of this form indicates that your contract is not a Strategic Digital Contract, you do not need to submit this form to the DTA.
- If after completing this form you decide to submit a report of Serious Underperformance, follow the prompts to complete this online.
- After submitting the Serious Underperformance Report form to the DTA, you must notify the Seller in writing that you submitted a Serious Underperformance Report naming them, unless extraordinary circumstances prevent this, such as legal constraints. This ensures the Seller is aware of the Serious Underperformance Report.
- By submitting this form, you acknowledge that you:
- have read, understood and followed all requirements and limitations relating to this form and the DSUP
- have read, understood and agree to the terms in the DTA's Privacy Policy.

Through use of this tool, you consent to the Digital Transformation Agency (DTA) collecting all relevant information for the purposes of assessing and determining and Serious Underperformance under the DSUP.
The privacy and security of any personal and commercial information is important to us and is protected by law. The DTA's Privacy Policy also explains how you can request access to or correct the information it holds, and who to contact if you have a privacy enquiry or complaint.
Your contact details will not be shared with anyone else.
The DTA will not provide any identifiable information provided by you to anyone else outside the DTA, unless you have given consent for us to do this, or we are authorised or required to do so by law.
All information provided through this reporting process will only be utilised for the purposes stated in the Digital Seller Underperformance Policy.
